Terms of service
Introduction
A feature of ANNAFOXY brand products is the observance of a zero-waste policy to care for the environment. The fashion industry is one of the biggest polluters on the planet due to the production of excesses on stock for immediate sale or shipment to customers. To avoid the production of unnecessary waste, we prevent the creation of significant stocks of finished products and strive to manufacture each item for a specific customer. This introduces a certain specialty to our terms of service, which we kindly ask you to accept with understanding for the sake of the future of our planet.
Contract Formation
The terms of service elaborated in this section are an accession contract, which terms are accepted by the buyer when placing an order on the website. Placing an order means concluding a contract for the sale of goods on the terms set forth in these rules.
Order Acceptance
The buyer’s consent to the conclusion of the contract is indicated by clicking the “Pay” button or (for countries where the option of deferred payment is available) clicking the “Checkout” button. The contract is considered concluded from the moment the buyer is notified by the seller’s customer service manager about accepting the order for work.
Third-Party Orders
The buyer can place an order for the benefit of a third party or several third parties (as a gift or for other reasons). In this case, the party to the contract is the buyer who placed the order. All further order fulfillment rules apply to such buyers, regardless of who is the recipient of the order.
Payment Obligations
With the conclusion of the contract, the buyer has an unconditional obligation to pay for the purchased items and their delivery. Payment must also be made in the event that the funds were returned to the client’s account for technical reasons or the client used the option of deferred payment (for countries where this option is available).
Order Fulfillment
In case of impossibility of fulfilling the order immediately, the term for the fulfillment of the order is agreed upon by the client service manager in communication with the client within 24 hours from the date of placing the order. If the manager is unable to contact the client, the order fulfillment period is considered to be set by default at 15 working days.
Completion of Obligation
The seller’s obligations are considered executed from the date the order is transferred to the postal delivery service. The buyer’s obligations are considered executed from the date when the last of the events took place: receipt of the order or payment of its value.
Risk Transfer
The risk of accidental destruction (loss) of the order passes to the buyer from the moment the seller transfers the order to the postal delivery service. The buyer’s right to property of the ordered manufactured product arises from the moment of its manufacture.
Contract Changes
The buyer cannot change or terminate the contract after the order has been placed without the seller’s consent. If necessary, changes to the order are discussed with the customer service manager; a change request can be sent to the email info@annafoxy.com.
Contract Termination
The contract can be terminated unilaterally by the seller before the ordered product is manufactured, with mandatory notification of the buyer and the return of all amounts paid by them.
Product Condition
The goods delivered to the buyer must be brand new and not used by other persons previously.
Incomplete Delivery
In case of incomplete delivery of the products (delivery of not the entire amount of the order), the seller is obliged to deliver the missing part of the order to the buyer at their own expense.
Quality Control
All items undergo thorough multi-level quality control before being shipped to the buyer. Claims of the buyer regarding defects in the quality of items are considered if they are declared within 24 hours from the moment of receipt of the goods. Photo confirmation of the defect is mandatory for product replacement.
Deferred Payment
The seller has the right to start the execution of the order with delivery by deferred payment (for the countries where this option is available) only after receiving from the buyer an advance payment covering the cost of postal delivery of the order.
Use of Brand Symbols
Brand symbols, signs for goods and services, and items of clothing with the seller’s logos are integral elements of the products sold. The buyer’s use of these elements or signs separately from the products or with the products of other companies without the separate prior consent of the seller is not allowed.
Applicable Law
In the part not regulated by these rules, Austrian civil law on the retail sale of non-food products via the Internet is applied to the contract of sale concluded on this website.
Priority of Terms
If any information presented on the site contradicts these Terms of Service, the provisions of the Terms of Service have priority application.
